1. Our approach
Arcavelo respects the intellectual property of others and expects its users to do the same. Almost everything in Arcavelo is private to the person who created it, but if you believe material stored through Arcavelo infringes your copyright, we will respond to notices that follow the U.S. Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.
2. Designated agent
Send copyright notices to our designated agent:
Jacob Knox
Attn: Copyright Agent, Arcavelo
Email: support@arcavelo.app (subject line “DMCA Notice”)
Please use that subject line only for copyright notices.
3. Filing a notice of infringement
Your notice must be in writing and include:
- your physical or electronic signature, as the copyright owner or someone authorized to act for them;
- identification of the copyrighted work you believe is infringed;
- identification of the material you believe is infringing, with enough detail for us to find it;
- your name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing may be liable for damages. Before sending a notice, consider whether the use might be a fair use, such as a student keeping a copy of their own course syllabus for personal planning.
4. What happens next
When we receive a valid notice, we will remove or disable access to the material, notify the user who stored it, and send them a copy of the notice.
5. Filing a counter-notice
If your material was removed and you believe that was a mistake or a misidentification, you can send our designated agent a counter-notice that includes:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before it was removed;
- a statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of a mistake or misidentification;
- your name, address, and telephone number; and
- a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which Arcavelo may be found), and that you will accept service of process from the person who sent the original notice or their agent.
If we receive a valid counter-notice, we will send a copy to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we will restore the material within 10 to 14 business days of receiving the counter-notice.
6. Repeat infringers
In appropriate circumstances, we will close the accounts of users who repeatedly infringe others’ copyrights, as described in the Terms of Service.
